By accessing or using shellz.org, Blackbird, NoNameGPT, or any related services (collectively, the "Services"), you agree to these Terms of Service.

If you do not agree, do not use the Services.

You are responsible for:

• Maintaining the security of your account.
• Protecting credentials, API keys, tokens, and passwords.
• All activity occurring under your account.

You may not use the Services to:

• Violate any law or regulation.
• Infringe intellectual property rights.
• Access systems or data without authorization.
• Distribute malware, phishing content, or harmful code.
• Conduct unauthorized scanning, exploitation, or denial-of-service activity.
• Bypass authentication, authorization, rate limits, licensing controls, or security measures.
• Interfere with the operation of the Services.
• Submit illegal, harmful, abusive, or fraudulent content.

You retain ownership of content you submit.

You grant us a limited, non-exclusive license to host, process, transmit, store, and display such content solely as necessary to operate, maintain, secure, and improve the Services.

The Services are provided on an "as is" and "as available" basis.

We may modify, suspend, restrict, or discontinue any feature or the Services at any time.

We do not guarantee uninterrupted availability, security, or error-free operation.

We may suspend or terminate access if we reasonably believe:

• These Terms have been violated.
• The Services are being abused.
• Security, legal, operational, or reputational risks exist.
• Continued access may expose us or others to liability.

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
• We are not liable for lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

Our total aggregate liability arising from or relating to the Services shall not exceed the greater of:

(a) the amount paid by you for the Services during the twelve months preceding the claim; or

(b) CAD $100.

Nothing in these Terms limits any rights that cannot be excluded under applicable law.

You agree to defend, indemnify, and hold harmless shellz.org, its owners, operators, contractors, service providers, and affiliates from claims, liabilities, damages, losses, costs, and expenses arising from:

• Your use of the Services.
• Your content.
• Your violation of these Terms.
• Your violation of law or third-party rights.

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein.

Any dispute shall be resolved in the courts located in British Columbia, Canada, except where applicable law requires otherwise.
